Part 3 Have a look at CoP: 8:117-120 -- pages 117-8. This sets it all out -- and there is nothing about delegation of funding in the form of block grants being a reason to withdraw a statement. If, however, it is shown that the child's needs can be sufficiently met from the normal resources of the school that the child attends -- the statement may be withdrawn -- that is the only (albeit important) aspect of funding to be considered. So, it is vital that it is clear in the "books" of your school, how much funding is delegated to your overall budget for SEN and how much of that is spent on clearly identifiable SEN provision. Number of SEN children, number with statements, number of TA hrs available etc. -- will be the main focus of interest by the Panel in respect of the LA case at appeal -- if they have no evidence that sufficient educational progress has been made by the child, so that the all of statemented objectives no longer apply. I have only had one LEA succeed in withdrawing a statement at appeal in 12+ yrs of representing parents. Hope this helps --- Brendan |
