Does he have a statement? With such percentile scores he warrants one. If  
parent ask LA for a statutory assessment, or re-assessment, they have to  gather 
evidence and reply in 6 weeks with a decision. If there is a refusal,  
parents can appeal to SENDIST. Via the statutory assessment, re-assessment and  
statementing process parent can trigger all of the required asesments  without 
cost. Child has a right to statutory assesssment and statementing, even  though 
he is in an independent school, as LAs are responsible for the SEN  of all of 
the pupils within its area whatever the eduational setting. So, using  the 
legal framework, an EP assesssment can be triggered cost free to the  parent. At 
appeal -- tribunals can order quantified provision in Part 3 to be  
additionally arranged/funded by the LA even if child is in the independenet  sector --
