I have posted on this key issue before;
Thanks Brendan (as usual) for a clear explanation of the legal situation.
I havent seen Susie's reply, but I get the gist from what you quoted.
The big problem  for me is the running of two parallel systems. 
Statemented children who have ringfenced money and School Action Plus 
children who are funded via delegated SEN funding.
Many of the children at School Action Plus have needs equal to or 
greater than those with Statements. This is for a mixture of reasons, 
variable panel decisions, children transferring in with statements from 
other LEAs, different levels of parental input, developing and changing 
needs. It takes time to put this right.
In  my LEA  primary schools must pay the first 10 hours of TA support of 
a statement from their SEN funding. So getting a statement takes 10 
hours of flexible TA time that I can deploy across the school as needed 
and attaches it to one child. Even if there are three children in one 
year group with statements , all must have the provision decreed in 
their statements. Would a tribunal agree that shared support between 3 
children for 3 times as long was "equivalent " would parents? Has anyone 
tried this? We try and rearrange to mixed age classes so that children 
with Statements are not in the same class, but this is not always 
appropriate) As it happens there are only 2 other children on the SEN 
Register in this class. While next door Fred, James,& John at School 
Action Plus and 6 others at School Action struggle on with minimal TA 
support because there is no funding left to support them to an 
equivalent level.. Meanwhile the children with Statements (and the rest 
of the class) are becoming overly dependent on TA support, because with 
4 adults in the room, this is very difficult to avoid.
ALL children have a legal right to receive the support they need, not 
just those with Statements. If we are talking about children reaching 
their full potential then it is as important for Fred at SChool Action 
to have the help he needs as Joe who has a Statement.
