Thanks to all who are helping me with this. I'm having e mail glitches at the moment. Some messages dont get thru' and some contain my full name - please delete any that have my full name to protect the identity of the children i teach. I hope noone gets this message three times! The news that the receiving LA has to defend an appeal is news to me.My LA didnt mention this! Does this apply both to refusals to Stat Assess and to refusals to issue a statement after Stat Assess? This child is making good progress with a high level of support. His current school had begun reducuing it. Howvere a new setting is likely to need more, not less support initially....Brendan, does the 2 month appeal period include the hoildays? If the clock for an appeal lodged in Augusts only starts ticking on Sept 3rd is their any benefit in lodging it before then? I may have dificulty contacting the family before term begins - and they will need a lot of support from IPSEA to go thru the appeal process. I am sure that this child's case would be upheld by a tribunal, but fear that by the time the process is gone thru he will have at best had a very stressful and difficult start in our school, and at worst have had to perm excluded for a major incident.
