The DfES publication "Access to education for children and young people with medical needs" Ref: DfES 0732/2001 <http://www.teachernet.gov.uk/docbank/index.cfm?id=3758> has also been mentioned by others I expect. I don't know if others suggested this: I understand that, in addition to parents, a school is able to make a formal request to the LEA for statutory assessment. I'm not mentioning this as a solution, but for consideration as a potential tool if you find yourself enduring protracted negotiations with your LEA. I couldn't imagine anyone having to say to an LEA officer "of course, if this emergency provision looks as if it might take too long for the LEA to put into place/fund, then: a) I understand that the parents are considering making a formal request for statutory assessment or b) the school feels it has no choice but to make a request for stat. assessment." In the SEN Code of Practice paragraphs 8:23 to 8:28 are headed 'Assessment and emergency placements' which is not strictly relevant to what you describe. Try replacing the word 'placement' with 'provision', which seems entirely reasonable, and some of these paragraphs seem more potentially relevant to the situation with your student.
