In my experience, you cannot refuse this child unless there is a 
threat to the education or health and safety of other children.  we've 
tried, including these issues, and lost the appeal.  Finance and 
resources is not considered an argument to refuse admission.  I'd be 
interested to know if anybody has ever won the argument and which 
county you are in.
