These rules are designed to protect everyone, but seem to leave little room for commonsense. The phrase about effective education of other children surely almost always includes child trying to gain a place at the school. I do wonder sometimes, about parents fighting against staff to have their child admitted. If the school is saying that in their professional opinion the school is not able to educate a child then either you agree and go elsewhere or disagree, in which case why do you want your child to go to that school anyway? I suppose one might hope to change heatrs and minds, but I'm not sure I'd want to use my child to do it. As to ways to argue against admission; My understanding is that you can refuse a child, with or without a statement if you don't have a place in the year group. This does not necessarily mean the class, but refers to the admission number set for the year. I have only hearsay evidence of 2 schools who have managed to argue against taking children on other grounds; One with a statement of BESD - the relevant class was housed in the hall and required to move all equipment and furniture to allow the serving of lunch, PE, assembly etc The school argued that this environment would be too disruptive for a child with severe BESD. The other school argued that they could not physically fit another desk in the classroom (and no other class could be accommodated in the room).
