A statement and the accountability power of the SENDIST needs to be triggered (or to be?in the background) as the SENDIST takes over and administers such powers if the appeal syatem is triggrered.

My recent experience has been of LAs agreeing to fund additional support (not the normal fees or?transport costs)?in an ordinarly mainstream indie -- rather than appear at a tribunal hearing --?if a reasonable use of public expenditure can be shown (which?an LA?has a legal duty to ensure). LAs have a duty also to administer their discretionary powers reasonably. So there is a balance to be struck as case law has demonstrated generally.

I also know of a straight split funding arrangement -- which I did not advise upon?directly upon (nor did any organisation with which I'm connected).

This is an area of rare and un-case-law'd discretion (a grey area) and has rarely been applied to my knowledge -- but is within an LAs discretion if it deems justified in reasonable use of public expenditure.?

Is there anyone who knows of, either personally or anecdotally, statemented   children in independent primary school having support funded by the Local   Authority? I'd be grateful for information, the more precisely referenced the   better.    Happy New Year - probably.    Susan
